Terms & Conditions

1.0 GENERAL

1.1 All goods sold by DragonFire Computing will be invoiced at the quoted price, If the amended invoiced price is unacceptable the customer will be entitled to return the goods to DragonFire Computing under the returns procedure within 7 days of delivery.

2.0 PAYMENT

2.1 All prices are quoted inclusive of value added tax.

2.2 VAT will be added at the prevailing rate.

2.3 There is a 2.6% surcharge for payments by credit/debit card such as Visa, Access, Mastercard, Switch and Solo.

2.4 There is no surcharge where payment is made by, Cash, building society cheque,, banker’s draft and direct transfer.

2.5 The customer will pay all amounts due to DragonFire Computing free from all deductions and without any set-off.

2.6 The customer shall not be entitled by reason of any claim against DragonFire Computing to withhold payment for the goods.

3.0 DELIVERY

3.1 Any dates quoted for the delivery of the goods are approximate only.

3.2 DragonFire Computing shall not be liable for any delay in the delivery of the goods howsoever caused.

3.3 Time for delivery shall not be the essence of the contract.

3.4 The goods may be delivered by DragonFire Computing in advance of the quoted delivery date upon giving reasonable notice to the customer.

3.5 The customer will accept delivery of the goods during normal business hours unless otherwise agreed in writing and will pay any additional charges resulting from his failure to accept in accordance with the agreed arrangements.

3.6 The customer may only refuse to accept delivery of the goods by reason of apparent transit damage. In all other cases refusal of delivery will be considered as wrongful rejection of the goods and the customer shall be liable for all appropriate charges arising from such refusal.

4.0 WARRANTIES

4.1 Unless otherwise agreed by DragonFire Computing and the customer and stated on the invoice, all goods sold by DragonFire Computing carry a 1 year return to base (RTB) warranty.

4.2 DragonFire Computing does not manufacture the goods and subject to the conditions set out below. The company sells the goods with the benefit of the manufacturers warranty and none other.

4.3 All warranties, conditions or other terms as to description, sellable quality, fitness for purpose or otherwise implied by common law are hereby excluded to the fullest extent permitted by law.

4.4 DragonFire Computing will accept liability for defective goods only to the extent that the company itself is entitled to make a corresponding claim under the manufacturer’s warranty.

4.5 In those instances where the supply of faulty goods is established as directly attributable to the company’s negligence, the company’s liability under this clause will be restricted to the price paid for the faulty goods and will not give rise to any breach of the contract or any other liability arising in connection with it.

4.6 DragonFire Computing accepts liability as stated above only if the total price of the goods has been paid by the due date for payment.

4.7 It is the responsibility of the customer to confirm availability and applicability of the manufacturer’s warranty (if any) and also the suitability for purpose whether of the customer or the goods being ordered.

4.8 DOA (dead on arrival) goods returned to DragonFire Computing within 7 days of the invoice date will be , barring any physical damage to the item(s) in question, replaced or credited according to the customer’s wishes.

4.9All other returns, if found faulty after testing by DragonFire Computing, will be replaced with same item or equivalent in function & performance depending on availability.

4.10 A 20 % handling charge would be made to the customer requiring credit on goods returned to DragonFire Computing after the DOA period of 7 working days.

4.11 The customer is responsible for postage and packing costs for any items sent to the company by post.

4.12 DragonFire Computing shall not be liable to the customer in any circumstances whatsoever for any consequential loss, whether for loss of profit or otherwise which arise out of or in connection with the supply of the goods or their use or resale by the customer or any breach of the contract or any liability arising in connection with the contract.

5.0 BUYER’S DEFAULT

5.1 Without prejudicing it’s rights, the company may terminate the transaction by giving notice to the customer or may so terminate any other contract between it and the customer and re-take possession of the goods if:

The customer does not make payments to DragonFire Computing by the due date stated on the invoice.

The customer, in accordance with the agreed arrangements fails to take delivery of the goods.

6.0 OTHER

6.1 No officer or member of staff of the company has the right to waive any of the above terms and conditions.

6.2 All cheques not cleared first time upon presentation will incur a minimum administration charge of £30.00 plus VAT.

6.3 These terms and conditions are subject to change at any time without prior notice to you.
